Article 1 - Purpose
The present General Conditions of Use (GCU) describe the operating rules of the French Academy in Rome's participative platform "l'Album de la Villa Médicis" (the "Platform"), through which any person having a Link* with Villa Médicis may upload photographs, films, recordings, archives (the "Documents") having a link with Villa Médicis.
Article 2 - Persons likely to contribute to the enrichment of the platform
By creating a user account to contribute to the Platform, you certify that you have a Link with Villa Medici, namely: (i) work or have worked at Villa Medici, or (ii) are or have been a resident, boarder or guest at Villa Medici, or (iii) are staying or have stayed at Villa Medici, and (iv) have reached the age of majority.
Article 3 - Information to be provided on registration
In order to create your user account, you agree to provide the following personal data: e-mail address, surname, first name, as well as your Link to Villa Medici.
Article 4 - Type of Documents that may be downloaded
As a user of the Platform, you agree to upload only Documents with a link to Villa Medici of which you are the author, or, if you are not the author, for which you hold sufficient rights for the uploaded Documents to be shown to the public. You agree to upload only Documents that are not contrary to public decency. In the event that any photographs or films uploaded show persons, you warrant that you have sought permission from such persons for their communication and exhibition on the Platform, and that the films or photographs were not taken without their knowledge, or are likely to constitute a violation of their privacy.
Article 5 - Editorial control
You accept that the Documents uploaded are subject to editorial control by the Platform administrators and the risk that they may not be retained, for whatever reason (inappropriate subject, redundant, etc.). In all cases, withdrawn images will be kept and archived by the Academy.
Article 6 - Free of charge
The uploading of Documents is free of charge and shall not give rise to any remuneration whatsoever.
Article 7 - Transfer of rights
By uploading the Documents, you agree to transfer to the French Academy in Rome, free of charge and non-exclusively, the right of representation and reproduction of the Documents, on the Platform or on its website, and for the duration of the intellectual property rights as they exist in the country of uploading and in all countries where the Platform may be consulted. You guarantee the French Academy in Rome a peaceful use of the Documents uploaded. Similarly, if you contribute to the Platform by writing a text related to the Documents, you agree to transfer to the French Academy in Rome the right of representation and reproduction of these texts, of which you certify you are the author, on any electronic or paper medium, worldwide, and for the duration of the intellectual property rights as they exist in the country of uploading and in all countries where the Platform may be consulted.
Article 8 - Withdrawal
You agree to inform the French Academy in Rome without delay of any claim relating to an uploaded Document, so that the French Academy in Rome can remove it immediately from the Platform if necessary.
Article 9 - Languages
These GCU are written in French. Any translation into any language is made for information purposes only, and only the French version will prevail in relations between the User and the French Academy in Rome.
Article 10 - Applicable law / Dispute
The present GTU are governed by French law and any dispute relating to the present GTU will, after an attempt at amicable settlement, be submitted to the competent courts within the jurisdiction of the Paris Court of Appeal.
